Field Sobriety Tests are a strong area in which to challenge the Commonwealth’s case. Field Sobriety Tests are divided attention exercises which are designed to do just that, divide your attention, by asking you to perform tasks. Some officers may ask you to touch your finger to your nose, balance on one foot, walk in a straight line despite the fact that the line is often imaginary, follow their pen with your eyes, recite the alphabet or numbers, etc. Your performance on these “tests” is entirely subjective, or in the officer’s perception, and therefore is open to attack. Just because you “failed” what an officer determined to be the standard for these roadside exercises does not mean that you will be convicted.
